Assalam u Alaikum!
Hoping for the best from Allah
for the whole Ummah.
I am here to discuss and
elaborate on our company’s
earnings.
We are running a software
house where different services
are available to clients.
Since the category that is going to be more or less engaging
depends on client traffic, our
video editing team has gotten
the fame and that’s the main
reason behind our earnings.
As we are worried about the
earning that is either Halal or
not, we are here.
I will divide my question into
two parts.
1) We are dealing with clients
online through channels like
Upwork, Fiverr,
Freelancer etc. where the platform will charge the seller
as well as the buyer for the
work. For example: If me and
my client agreed on a project
worth Rs 100, these platforms
will charge the client Rs 105
and will give me Rs 80, while
they will keep the remaining Rs
25 for themselves as platform
charges. So, is it Haram or
Halal for us to use these
platforms for earnings?
2) Our video editing services
are getting famous in the following categories:
• Product Ad videos
• Gaming videos for YouTube

Adding subtitles to videos
• Adding background music to videos
• Singer video editing
• Dancer video editing
• Cartoon
video creation
• Nature video
editing
• Informative video
editing
If there is any chance of a
Halal earning in the categories
mentioned above, please let us
know which one is Halal & which one is Haram, in details
if possible, please.

الجواب باسم ملھم الصواب حامدا و مصلیا

1. Both parties are giving services.If the fee was agreed initially with mutual understanding, than it's ok. You can use these platform.As fees of platform varies, depending on total amount, so percentage should be decided such as 40%of total fees,so that there will be no ambiguity.

2.This video editing fees is halal under following conditions
a)There is no music .
b)Product is halal .Promotion of haram product was not allowed .Also promotion of conventional bank was not allowed.
c) editing a gaming video is makroh as it is lahw o laab(لہو و لعب ) with the condition that there is no appearance of women in it.
d)Editing of singer or dancer video is not allowed.
e)Adding of Subtitles depend upon nature of video.If that video is allowed than this was also allowed.
f)Editing of Video in which there is female, is also not allowed.
g)Editing of Nature related videos and informative Science and technology Videos are allowed.

عن أبي مسعود -رضي اﷲ عنہ- قال: نہی رسول اﷲ صلی اﷲ علیہ وسلم عن ثمن الکلب، ومہر البغي، وحلوان الکاہن

و فی البحر الرائق شرح كنز الدقائق ومنحة الخالق وتكملة الطوري، جلد 8 ص23

وَلَا يَجُوزُ عَلَى الْغِنَاءِ وَالنَّوْحِ وَالْمَلَاهِي) ؛ لِأَنَّ الْمَعْصِيَةَ لَا يُتَصَوَّرُ اسْتِحْقَاقُهَا بِالْعَقْدِ فَلَا يَجِبُ عَلَيْهِ الْأُجْرَةُ مِنْ غَيْرِ أَنْ يُسْتَحَقَّ عَلَيْهِ؛ لِأَنَّ الْمُبَادَلَةَ لَا تَكُونُ إلَّا عِنْدَ الِاسْتِحْقَاقِ وَإِنْ أَعْطَاهُ الْأَجْرَ وَقَبَضَهُ لَا يَحِلُّ لَهُ وَيَجِبُ عَلَيْهِ رَدُّهُ عَلَى صَاحِبِهِ۔۔۔۔۔۔۔۔وَفِي شَرْحِ الْكَافِي وَلَا يَجُوزُ الْإِجَارَةُ عَلَى شَيْءٍ مِنْ الْغِنَاءِ وَاللَّهْوِ وَالنَّوْحِ وَالْمَزَامِيرِ وَالطَّبْلِ وَلَا عَلَى الْحِدَاءِ وَقِرَاءَةِ الشِّعْرِ وَلَا غَيْرِهِ وَلَا أَجْرَ فِي ذَلِكَ هَذَا فِي الطَّبْلِ إذَا كَانَ لِلَّهْوِ أَمَّا إذَا كَانَ لِغَيْرِهِ فَلَا بَأْسَ بِهِ كَطَبْلِ الْقِرَاءَةِ وَطَبْلِ الْعُرْسِ وَفِي الْأَجْنَاسِ وَلَا بَأْسَ أَنْ يَكُونَ لَيْلَةَ الْعُرْسِ دُفٌّ يُضْرَبُ بِهِ لِشُهْرَةِ الْعُرْسِ وَفِي الْوَلْوَالِجيَّةِ رَجُلٌ اسْتَأْجَرَ رَجُلًا لِيَضْرِبَ الطَّبْلَ إنْ كَانَ لِلَّهْوِ لَا يَجُوزُ وَإِنْ كَانَ لِلْغَزْوِ وَالْقَافِلَةِ يَجُوزُ

و فی الدرالمنتقی علی مجمع الأنہر، کتاب الإجارۃ، باب الإجارۃ الفاسدۃ، دارالکتب العلمیۃ بیروت جلد 3 ص530

الفاسد ما یکون مشروعا بأصلہ دون وصفہ، والباطل مالیس مشروعا أصلا۔

و فی مجمع الأنهر في شرح ملتقى الأبحر، جلد2 ص391

وَلَا يَسْتَحِقُّ) الْأَجِيرُ الْمُشْتَرَكُ (الْأَجْرَ حَتَّى يَعْمَلَ كَالصَّبَّاغِ، وَالْقَصَّارِ) وَنَحْوِهِمَا؛ لِأَنَّ الْإِجَارَةَ عَقْدُ مُعَاوَضَةٍ فَتَقْتَضِي الْمُسَاوَاةَ بَيْنَ الْمُعَوِّضَيْنِ فَمَا لَمْ يَسْلَمْ الْمَعْقُودُ عَلَيْهِ لِلْمُسْتَأْجِرِ وَهُوَ الْعَمَلُ لَا يَسْلَمُ لِلْأَجِيرِ الْعِوَضُ وَهُوَ الْأَجْرُ
